STATEMENT: On the U.S. District Court Decision to Uphold the Landmark O’Donnell Consent Decree
Yesterday marked an important victory in the ongoing fight to ensure that wealth does not determine the level of justice an accused person receives. The United States District Court denied a motion to vacate the O’Donnell Consent Decree — the landmark order that transformed Harris County’s misdemeanor bail system.
Our office represents 100 percent of people who appear for magistration following arrest, and we see every day how the Decree’s General Order Bond process protects both constitutional rights and public safety. The data and our experience reinforce what public defenders have long understood: you can maintain community safety without resorting to unconstitutional wealth‑based detention,without creating massive case backlogs, and while ensuring that tens of thousands of low‑risk people are not unnecessarily jailed.
This ruling affirms that a fairer, more effective misdemeanor system is not only possible — it is already working.
